Constitutional Collision: Questions to Assess the 2026 National AI Framework

Building on Section 8 of the December 2025 Executive Order, [1]  the Trump administration’s “National Policy Framework for Artificial Intelligence,” (the “Framework”) released on March 20, 2026, provides a formal legislative blueprint for advancing the administration’s goal of a uniform, national policy for AI across the United States. [2]  While the Executive Order provided only the outline of a national legislative scheme, the current Framework provides greater specificity regarding the statutory goals of an AI bill. Yet an omnibus statute incorporating provisions meant to achieve all these goals will likely face a gauntlet of constitutional challenges. This article explores a series of questions to assess the viability of several of these goals. While this discussion addresses only a subset of the potential friction points, they are where the rubber hits the road for any legislation seeking to achieve the Framework’s goals. Not Too Late: Biden Administration Urged to Make Pro-Business Immigration Moves Now

  The Biden Administration is being urged to finalize some business immigration issues before Jan. 20, 2025 , when the next presidential administration takes office, including: Surge resources:  Democratic lawmakers  asked USCIS to “surge” resources  to eliminate the backlog of employment authorization applications (for new arrivals and other non-citizens) using the $34 million that had been set aside for discharging backlogs with new technologies, staffing increases, and greater use of worker overtime . H-1B modernization:  Business immigration advocates  are asking USCIS  to finalize more parts of the  Modernizing H-1B Requirements, Providing Flexibility in the F-1 Program, and Program Improvements Affecting Other Nonimmigrant Workers Rule . TSA Proposes Moving REAL ID Compliance for Domestic Fliers to 2027

  The Transportation Security Administration (TSA) has proposed delaying enforcement of the REAL ID requirement for passengers of domestic airlines to give travelers two more years to update to REAL ID-compliant identifications. The proposal is   open for comments   until Oct. 15, 2024. The REAL ID Act was passed by Congress based on the 9/11 Commission’s recommendations. Full enforcement for domestic air travelers was scheduled to go into effect in May 2025. That date  likely will be pushed to 2027 . Under REAL ID security regulations, all passengers 18 years and over on domestic airlines would need a REAL ID-compliant identification to board. Although various documents are REAL ID-compliant, the key document became state-issued REAL ID-compliant driver’s licenses. Approximately 53 percent of the U.S. population had REAL ID-compliant identifications in 2023 when the deadline was pushed to May 2025.
