Policy Week in Review – April 11, 2025

At a Glance The Policy Week in Review, prepared by Littler’s Workplace Policy Institute (WPI), sets forth WPI’s updates on federal, state, and local matters, as well as Littler’s published in-depth analyses of the prior week. Supreme Court Temporarily Blocks Decision Allowing Reinstatement of NLRB Member Wilcox  On April 7, the U.S. Court of Appeals for the D.C. Circuit  ruled  that National Labor Relations Board Member Gwynne Wilcox could return to work while she challenges her removal. On April 8, the Trump administration appealed the April 7 ruling to the Supreme Court. On April 9, Supreme Court Chief Justice John Roberts ruled that the Wilcox termination will stay pending resolution of the appeal. The D.C. Circuit is scheduled to hold oral arguments in the case in May . After arguments, the court will decide the case on the merits. President Trump Decreases Minimum Wage for Federal Contractors

On March 14, 2025, President Trump issued an  executive order  ending the obligation to pay individuals working on or in connection with certain federal contracts or subcontracts a minimum wage currently set at $17.75 per hour . In particular, Trump has rescinded 18 Biden executive orders, including Biden’s Executive Order 14026 that had increased the federal contractor minimum wage. A federal contractor minimum wage was first established by President Obama through his  Executive Order 13658 of February 12, 2014 (Establishing a Minimum Wage for Contractors)  (the “Obama E.O.”). The Obama E.O. applied to government contracts and subcontracts involving construction, services, or concessions or connected with federal property or lands and related to offering services for federal employees, their dependents, or the general public.
