White House Unveils Executive Order Promoting Artificial Intelligence Innovation and Security

ADA Implications of Potential Marijuana Rescheduling

In December 2025, President Trump  issued an Executive Order  directing the Department of Justice to complete the rulemaking process to move marijuana from a Schedule I to a Schedule III controlled substance under the federal Controlled Substances Act.   While the Executive Order is aimed at legalizing marijuana research and does not change the current law, it may significantly impact how employers address medical marijuana in the workplace under the Americans with Disabilities Act (ADA).   Accordingly, employers should understand that existing legal obligations and workplace policies are not yet affected.  Over the last ten years, with a majority of states legalizing the use of medical marijuana to treat debilitating conditions, employers throughout the country have been forced to answer whether they have to accommodate an employer’s lawful use of medical marijuana during non-working hours . President Signs Executive Order to Limit State Regulation of Artificial Intelligence

On December 11, 2025, President Trump  signed an executive order   purporting to limit the ability of states to regulate the use of artificial intelligence (AI) . The order’s stated purpose is to ensure that American AI companies are “free to innovate without cumbersome regulation” and to “remove barriers to American AI leadership.” The order cites the proliferation of AI legislative proposals in state legislatures as undermining that goal (although it bears note that few if any of these proposals have or are likely to become law). The order specifically cites as problematic a recently enacted California state law, which it claims requires “complex and burdensome disclosure… based on the purely speculative suspicion that AI might ‘pose significant catastrophic risk.’” It further references Colorado state law regarding algorithmic discrimination, claiming that that law “may even force AI models to embed DEI in their programming.” The order goes on to state that the administrat...

Trump Moves to Pre-empt State AI Laws with Executive Order

President Donald Trump on Dec. 11  issued an executive order , challenging state laws regulating artificial intelligence. The order directs the attorney general to establish a task force within 30 days focused on litigation against state AI laws. It also empowers the secretary of Commerce to publish a review of “onerous” state AI laws within 90 days and restrict federal broadband funds to states whose AI laws are found to be objectionable. It directs the Federal Trade Commission to issue within 90 days a policy clarifying how the agency’s prohibition on unfair or deceptive practices applies to AI systems. The Federal Communications Commission must within 90 days initiate proceedings to consider creating a federal reporting and disclosure regime for AI models that would pre-empt conflicting state requirements.
