Delaware Modifies its Paid Family and Medical Leave Program

Delaware has enacted  HB 128  (“the Act”), which modifies the state’s upcoming paid family medical leave program (“ Delaware Paid Leave ”) before benefits become available on January 1, 2026. The Act became effective immediately upon enactment on July 30, 2025.  The Act significantly amends the provisions governing how an employer’s paid leave policies integrate with and coordinate with Delaware Paid Leave benefits . First, the Act provides that Delaware Paid Leave is the primary payor of benefits . As such, an employer’s disability insurance benefits may be offset by Delaware Paid Leave, per the terms of the disability policy . Other available income replacement benefits must be coordinated with Delaware Paid Leave benefits according to the terms of the policy or procedure governing other available benefits.  Second, the Act rescinds a provision that allowed an employer to require an employee to use accrued paid time off before accessing Delaware Paid Leave benefit...

Washington State Scales Up Paid Family and Medical Leave Law

On May 20, 2025, Washington Governor Bob Ferguson took the final step toward implementing  House Bill (HB) 1213 ’s expansion of the state’s paid family and medical leave program when he greenlit funding for the program as part of the state appropriations budget for the 2025-2027 biennium. With this funding, the new law will take effect on January 1, 2026. Quick Hits Washington State’s HB 1213 expands job protection rights under the state’s paid family and medical leave program. The amended leave program reduces the minimum increment of time off from eight consecutive hours to four consecutive hours. Maine DOL Issues Proposed Rules for Paid Family and Medical Leave Program

  The Maine Department of Labro issued proposed rules for the state's Paid Family and Medical Leave Program, providing employers with initial clarification regarding covered employees, contribution amounts, substitution of private plans, and other facets of the law. Public comment period for the proposed rule closes on July 8, 2024. While the department’s proposed rules answer several critical questions, revisions to the proposal are expected following the public comment period. According to the PFML Benefits Authority (the fifteen-member committee tasked with advising the department on its rulemaking process), the department will issue revised rules this fall, after reviewing and addressing public comments submitted by the July 8 deadline.
